Premise (Imidacloprid 30.5% SC) Pre-construction warranty for 10 years

TERMS AND CONDITIONS OF WARRANTY

 

  1. Only Envu Pest Expert Alliance (EPEA) members are eligible for this warranty
  2. This Warranty will be issued only for the new projects commencing from 15th March 2025 onwards
  3. This warranty will be valid only upon submission of the completed form to Envu’s Head office (or via online submission) within one month from the date of treatment.
  4. The form must be complete in all respects, subject to the satisfaction of Envu and should be submitted with all the relevant documents mentioned in the form. Envu reserves the right to reject any form if such form is not correctly/ completely filled by the Pest Control Company [hereinafter referred to as the ‘’PCC’’] or to call for additional documents – along with the form, if it deems fit. Envu’s decision in this regard shall be final and binding on the PCC
  5. This Warranty is subject to the execution of Pre-construction Anti-termite Treatment based on the norms and modalities of IS 6313 Specification of the Bureau of Indian Standards* (latest revision in effect at the time of the treatment) by the PCC (hereinafter referred to as “Treatment”)
  6. This Warranty is applicable only for the construction sites having a bare minimum area of 3400 sq.mt. or those requiring a minimum of 50 liters of Envu product Premise for conducting the Treatment.
  7. The Warranty will cease to operate in case of any alteration to the Property after the Treatment such excavation under floors, breaking of walls, laying of piped gas lines, and telephone cables, planting trees etc. as any such activity may compromise the efficacy of the termite Treatment.
  8. This Warranty will cease to operate in the event the Property is affected by natural calamities such as flood, earthquake, typhoons, hurricanes or events of a similar nature. It shall also cease to operate if the Property is affected by fire, in whichever form as may be.
  9. In the event that termite infestation occurs, Envu shall provide necssary quantity of Premise (Imidacloprid 30.5% SC) as per the actual requirement subject to case-to-case evaluation based on inspection by Envu’s representative. The total quantity supplied under this Warranty shall not exceed 20% of the original volume of the product used for carrying the Treatment.
  10. Premise should only be used as per the directions provided in the Envu’s literature (recommended on label and leaflet of the product container), which accompanies Premise at the time of purchase.
  11. The Warranty shall stand revoked if it is determined by Envu that Premise was not used as per the specifications*. Envu reserves the right to assess the quality of treatment carried out and determine the quantity of product required for retreatment, based on its independent evaluation. In case of any dispute, Envu’s decision on the PCC’s claim shall be final and binding.
  12. The Warranty does not extend to any external applications (e.g., wood, termite infested trees in the constructed site, or other material) or treatment against insect pest other than subterranean termites.
  13. The Warranty for application to a constructed site will be limited to comprehensive treatment (i.e., treatment of soil along external perimeter of the building and drill, fill and seal treatment of the internal walls of the ground floor only) of the site based on Envu’s sole discretion.
  14. The Warranty shall be revoked if any other product is used for termite control treatment after the use of Premise, within a period of 120 months, or if a single project is treated with any brand of Imidacloprid 30.5% SC other than Envu’s brand (Premise 30.5% w/w SC).
  15. This Warranty is independent of any guarantee or Warranty that the PCC extends in its personal capacity to the Property it treats.
  16. Envu does not undertake any guarantee / Warranty on the quality of service extended to the end user by the PCC and disclaims any liability for poor workmanship or improper application.
  17. Notwithstanding anything contained herein, the total liability of Envu shall in no event exceed 20% of the Premise used by the PCC. Envu shall not be liable for any direct, indirect incidental or consequential damages arising out of or related to the use of Premise in the treatment, including but not limited to termite infestation damages.
  18. Any controversy, claim or dispute arising in connection with this Warranty, including its applicability and interpretation, shall be resolved at the sole discretion of Envu. The decision of Envu shall be final and binding on the PCC. This Warranty shall be governed by Indian laws and any disputes shall be subject to the exclusive jurisdiction of the Courts in Mumbai.
  19. Envu reserves the right to discontinue the issuance of this Warranty at any time without prior notice to the PCC or any other party.
  20. The PCC shall indemnify and hold harmless Envu from any third-party claims, losses, damages, liabilities, costs, or expenses arising out of any breach of these terms by the PCC or improper execution of the Treatment.
